Segment 1: Statue 2477

Our first story deals with a law suit ten years in the making in Kane County. It's a lawsuit that was initiated by a third party between two parties embroiled in a conflict over ownership of the roads. Sounds confusing but it is a compelling story and the outcome you'll find very interesting. Terry Wood will cover the history of revised statue 2477 or simply RS2477. This law that simply reads, ": THE RIGHT OF WAY FOR THE CONSTRUCTION OF HIGHWAYS OVER PUBLIC LANDS, NOT RESERVED FOR PUBLIC USES, IS HEREBY GRANTED," has created a great deal of controversy or ownership of roads. Recently the Tenth Circuit Court of Appeals Ruled that the wilderness groups lack standing to sue in the Kane County Road Case.

 

Segment 2: Order 3310

On the 23rd of December a Christmas present Secretary of the Interior Ken Salazar passed order 3310 it was called the wildlands order. The BLM put out this policy and a manual with the determination that local BLM leaders would be able to determine in their future planning and consider wilderness characteristics for land planning, Utah's counties and the state believe that it's an extension of wilderness study areas and wilderness designations that fall outside of the purview of congress. That led to a conflict and that lead to director Abbey coming to Salt Lake City for a meeting.

 

Segment 3: Statue 2477 Round Table Pt. 1

Kane County Commissioners Doug Heaton and Jim Matson along with Mark Ward from the Utah Association of Counties discuss the recent court decision on RS2477 along with the wildlands order, as they discuss the importance of access to counties for transportation, grazing, and maintenance.
